Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ProductionPlanner.io website, web application, and all associated services (collectively, the "Service") operated by Barker Technologies AB, a company registered in Sweden ("we", "us", or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

We may update these Terms from time to time. When we do, we will notify you by email or by posting a notice within the Service before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

1. The Service

ProductionPlanner.io is a collaborative project management tool built for production teams. It provides scheduling, resource management, budget tracking, team coordination, messaging, and related features through a web-based platform.

2. Accounts

To use most features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to provide accurate and complete information when creating your account and to keep it up to date. If you become aware of any unauthorized use of your account, you must notify us immediately.

3. Communications

By creating an account, you agree to receive service-related emails from us, including account verification, security notices, billing, and product updates. You may opt out of non-essential communications at any time.

4. Intellectual Property

The Service, including all software, design, text, graphics, logos, and other content created by us, is our property and is protected by intellectual property laws. You may not copy, modify, distribute, reverse engineer, or create derivative works based on the Service.

You retain full ownership of all data, files, and content you upload to or create within the Service ("Your Content"). We do not claim any intellectual property rights over Your Content.

5. Use License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service in accordance with these Terms and your selected plan.

Free plan: We offer a free tier with limited features. No payment method is required. We reserve the right to modify or discontinue the free plan at any time with reasonable notice.

Paid plans: Paid plans provide access to additional features as described on our pricing page. The scope of your license corresponds to the plan you have purchased.

6. User Conduct

You agree not to use the Service to:

• Engage in any activity that violates applicable laws or regulations
• Upload or share content that is illegal, defamatory, discriminatory, or harassing
• Distribute malware, viruses, or any other harmful code
• Attempt to gain unauthorized access to the Service, other accounts, or related systems
• Interfere with or disrupt the integrity or performance of the Service
• Scrape, crawl, or otherwise extract data from the Service through automated means without our written consent

You are responsible for all content uploaded, shared, or communicated through your account and within projects you manage. We do not pre-screen user content and bear no liability for content created or shared by users.

7. Payment Terms

Free plan: No payment information is required to use the free plan.

Subscriptions: Paid plans are billed on a recurring basis (monthly or annually, depending on your selection). By subscribing, you authorize us to charge your payment method at the start of each billing cycle.

Cancellation: You may cancel your subscription at any time through the Service. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time within a billing cycle.

Refunds: First-time purchases are eligible for a full refund within 14 days if you are not satisfied. After 14 days, or for renewal charges, payments are non-refundable.

Price changes: We may change our pricing with at least 30 days' notice. Price changes take effect at the start of your next billing cycle after the notice period.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

You may export or delete your data at any time through the Service. If you delete your account, we will delete your personal data within 30 days. Backups containing your data will be purged within 90 days.

9. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We will make reasonable efforts to notify users in advance of planned maintenance that may cause significant downtime.

10. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Service, regardless of whether we have been advised of the possibility of such damages.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the Service immediately and without prior notice if you violate these Terms or engage in conduct that we reasonably believe is harmful to the Service, other users, or us.

You may terminate your account at any time by deleting it through the Service. Upon termination, your right to use the Service ceases immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Sweden.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service. These Terms supersede any prior agreements or understandings, whether written or oral.
